1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Gearny, a Texas company ("Gearny," "we," "us," or "our"), governing your use of the Gearny platform and services.
2. Platform Services
Gearny provides a platform that connects vehicle owners with qualified auto repair shops. Our services include:
- Quote request submission
- Shop discovery and comparison
- Communication facilitation
- Review and rating systems
3. Privacy Protection
3.1 Contact Information Protection
We will never share your contact information with any shop without your explicit approval of their quote.This means:
- Shops cannot see your phone number or email until you accept their quote
- You will not receive unsolicited calls or emails from shops
- Only shops whose quotes you approve can contact you directly
- We prevent spam and unwanted solicitation
3.2 Quote Process
When you submit a quote request:
- We share your vehicle and service needs with relevant shops
- Shops provide quotes without seeing your contact information
- You review quotes and shop profiles
- Only when you approve a quote do we share your contact details with that specific shop
4. SMS and Text Messaging Services
4.1 SMS Consent and Opt-In
By providing your mobile phone number and using our services, you expressly consent to receive text messages (SMS) from Gearny related to:
- Quote request confirmations and updates
- Shop quote notifications
- Service appointment reminders
- Platform updates and important notices
4.2 Message Frequency and Charges
Message frequency varies. You may receive multiple messages per quote request or service interaction. Message and data rates may apply. Check with your mobile carrier for details about your messaging plan and potential charges.
4.3 Opt-Out Instructions
You can opt out of receiving SMS messages at any time by:
- Replying STOP to any text message from us
- Contacting us at support@gearny.com
- Updating your preferences in your account settings
After opting out, you will receive one final confirmation message, and then no further messages will be sent to your mobile number unless you re-opt in.
4.4 Carrier and Device Requirements
SMS services are available on most major U.S. mobile carriers. Service may not be available on all carriers or in all areas. We are not responsible for delayed or undelivered messages due to carrier or device limitations.
4.5 SMS Data Protection
Your mobile information will not be sold or shared with third parties for promotional or marketing purposes.All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.
5. Customer Responsibilities
You agree to:
- Provide accurate information about your vehicle and service needs
- Provide a valid mobile phone number for SMS communications
- Communicate respectfully with shops
- Honor approved quotes within reasonable timeframes
- Pay shops directly for services rendered
- Provide honest reviews and ratings
- Notify us of any changes to your contact information
6. Platform Limitations
6.1 No Service Guarantee
Gearny is a platform that facilitates connections between customers and shops. We do not:
- Perform automotive services
- Guarantee the quality of shop services
- Warrant shop qualifications or certifications
- Assume responsibility for shop performance
6.2 Shop Relationships
Your contractual relationship for automotive services is directly with the shop, not with Gearny. We are not party to any agreements between you and shops.
7. Dispute Resolution
While we encourage resolution of disputes directly with shops, we may assist with communication. However, we are not responsible for resolving service disputes or quality issues.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, GEARNY SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM:
- Shop services or workmanship
- Vehicle damage during repairs
- Disputes with shops
- Platform downtime or technical issues
- SMS delivery failures or delays
9. Governing Law
These Terms shall be governed by the laws of the State of Texas. Any disputes shall be resolved in the state or federal courts located in Harris County, Texas.
